Rape

Rape is any act of vaginal, anal, oral or any other kind of penetration for sexual purposes imposed on another person without his or her consent, using a part of the human body or an object, by violence, threat, coercion or surprise. Thus on a minor of fifteen years of age, even with his/her consent. However, if they are married, the presumption of consent of the spouses to the sexual act is valid until proven otherwise.

SEXUAL ASSAULT

Sexual assault is any form of contact of a sexual nature without the consent of the victim and not leading to or not based on an act of penetration (absence of penetration). It is an expression of abuse of power because the perpetrator wishes to subjugate a person (adult, minor or woman) to his or her own desires by using violence, coercion (moral or physical), threat (announcing reprisals in case of refusal) or surprise (taking advantage of the victim's unconsciousness or state of unconsciousness). There are several types of sexual assault.

PHYSICAL ASSAULTS

These acts are manifested by :

> Assault and battery > Domestic and spousal violence > Torture > Violence against a minor or a person incapable of self-protection > Degrading treatment > etc

EARLY MARRIAGE AND STRONG MARRIAGE

Anyone who compels a person to enter into a civil, customary or religious matrimonial union.

DENIAL OF RESOURCES, OPPORTUNITY OR SERVICE

Denial of resources, opportunities or services is when a person is prevented from enjoying a particular right. This is the case when a woman is prevented from accessing (land) property or her inheritance; it is also the case when a girl is prevented from going to school.

> Voluntary deprivation of food and care > Refusal to pay court-ordered maintenance

PSYCHOLOGICAL AND/OR EMOTIONAL ABUSE

These types of acts are manifested by the infliction of pain, insults, intimidation, blackmail, etc. Most often, these acts are the result of abuse of power or authority, family or social problems.
